Liability Waiver & Release of Claims

IMPORTANT - Please Read Carefully:
- ⚠️ You assume risks: Drone operations involve inherent risks (equipment failure, weather, property damage)
- ⚠️ You release us from liability: You agree not to sue us for damages except in cases of gross negligence or intentional harm
- ⚠️ You indemnify us: You agree to defend us against claims from third parties related to our work on your property
- ⚠️ Insurance limits apply: Our liability is capped at our insurance coverage or the service fee, whichever is greater
- ⚠️ Your property, your risk: You accept responsibility for pre-existing conditions and hidden defects we couldn't reasonably discover
- ⚠️ Required for service: Signing this waiver is mandatory to receive drone services
- ⚠️ Safety first: We won't operate if conditions are unsafe, but you acknowledge aerial operations carry risk
BY SIGNING BELOW OR ACCEPTING ELECTRONICALLY, YOU WAIVE IMPORTANT LEGAL RIGHTS. CONSULT AN ATTORNEY IF YOU HAVE QUESTIONS.

1. Acknowledgment and Assumption of Risks
I, [CLIENT NAME] ("Client" or "I"), on behalf of myself and the property located at [PROPERTY ADDRESS], acknowledge and understand that the drone services provided by TriValley Drones, LLC ("Company") involve inherent risks and hazards.
1.1 Risks I Understand and Accept
I specifically acknowledge the following risks associated with drone-based soft washing and inspection services:
Drone Operation Risks:
- Equipment malfunction, failure, or loss of control mid-flight
- Impact with building surfaces, windows, or structural elements
- Falling debris, dislodged materials, or dropped equipment
- Noise, disturbance, or disruption to building occupants
- Wind gusts, turbulence, or unpredictable weather changes
- GPS interference, signal loss, or navigation errors
Soft Washing & Cleaning Risks:
- Water intrusion through cracks, gaps, windows, or unsealed areas
- Damage to deteriorated, fragile, or weakened surfaces
- Chemical reactions with unknown coatings, paints, or materials
- Staining, discoloration, or uneven cleaning results
- Damage to vegetation, landscaping, or surrounding areas
- Slippery surfaces during and after cleaning operations
- Inability to remove all stains, algae, or biological growth
Inspection & Assessment Risks:
- Limited visual perspective - cannot see inside walls, under surfaces, or hidden areas
- Potential failure to detect all defects, damage, or structural issues
- Weather, lighting, or environmental conditions affecting image quality
- Camera lens distortion or technical limitations
- Observations are visual only - not engineering or structural analysis
Property & Third-Party Risks:
- Damage to pre-existing defects, weak materials, or deteriorated components
- Discovery of underlying problems previously hidden or unknown
- Claims from tenants, neighbors, or third parties
- Disruption to business operations or loss of use during service
- Incidental capture of neighboring properties or individuals on camera
1.2 Voluntary Assumption of Risk
I VOLUNTARILY ASSUME ALL RISKS associated with Company's drone operations and services, including those risks listed above and any other risks not specifically enumerated. I understand that these risks may result in personal injury, property damage, financial loss, or other harm to me or third parties.
2. Release and Waiver of Liability
2.1 General Release
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE TriValley Drones, LLC, its owners, officers, employees, agents, contractors, insurers, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to drone operations on my property.
🚨 IMPORTANT EXCEPTIONS - We Are Still Liable For:
- Gross Negligence: Reckless disregard for safety
- Intentional Misconduct: Willful or malicious acts
- Fraud: Intentional misrepresentation or deceit
- Violations of Law: Claims that cannot be waived under California law
3. Indemnification and Hold HarmlesAgreement
I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS Company from any claims by third parties related to services performed on my property.
4. Limitation of Liability and Damages
Company's total liability shall not exceed the greater of: (a) the service fee paid, or (b) insurance policy limits.

⚠️ BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS LIABILITY WAIVER AND RELEASE OF CLAIMS, FULLY UNDERSTAND ITS CONTENTS, AND VOLUNTARILY AGREE TO ITS TERMS.
